服务条款

欢迎使用魄影（Ploctor）。本条款是你与魄影团队（以下称“我们”）之间关于使用魄影 Mac 应用、ploctor.com 网站及相关在线服务（以下合称“服务”）的协议。注册账户、购买积分或订阅、或使用服务，即表示你已阅读并同意本条款和《隐私政策》。如不同意，请停止使用。
一、账户
你需年满 14 周岁才能注册账户；不满 18 周岁的，应在监护人同意和指导下使用。
请提供真实有效的邮箱，并妥善保管密码。通过你的账户进行的操作视为你本人的操作；发现账户被盗用，请立即联系我们。
一个账户只供一人使用，不得出售、出租或转让。
二、服务内容
应用的本地编辑功能（图层、蒙版、选区、调色、滤镜、修图、排版等）免费使用，不需要账户。
在线 AI 功能（生图、改图、放大、抠图、拆分图层、AI 助手等）需要登录，并按每次使用消耗积分。每次提交前会显示预计积分；任务失败时，预留的积分会退回。
在线 AI 由第三方模型服务商提供。可用的模型、效果、速度和价格可能随服务商变化而调整，我们会尽力保持服务稳定，但不保证每个模型始终可用。
我们可能不时更新、增加或调整功能。应用通过自动更新获得新版本。
三、积分、订阅与付款
积分用于在线 AI 功能。积分不过期（服务终止的情形见第九条），但不能兑换现金、不能转让给其他账户。
订阅按月或按年自动续费，续费前可随时取消；取消后当期结束前照常使用，不再续费。年付订阅的积分按月发放。
积分包为一次性购买。价格以购买页面显示为准，可能含税费或由支付渠道收取的费用。价格调整不影响已完成的购买；已订阅的用户在续费前会看到新价格。
网站付款由 Stripe 处理；在 App Store 购买的，付款、续费和退款适用 Apple 的规则。
四、退款
积分和订阅属于购买后即可使用的数字服务，原则上不予退款。
以下情形我们会在核实后退款：重复扣款；因我们的系统故障导致付款后未收到积分或订阅无法使用；法律法规规定应当退款的其他情形。请在付款后 30 天内发邮件至 support@ploctor.com，附上订单号。
退款后，这笔付款发放的积分会按退款比例收回。如你向银行或支付渠道发起拒付，相关积分会在处理期间冻结或收回。
五、你的内容与 AI 生成内容
你上传的图片、输入的文字和你的项目（“你的内容”）归你或原权利人所有。你授权我们在提供服务所需的范围内处理你的内容，包括把它发送给模型服务商以完成你的请求。我们不会用你的内容训练模型。
在法律允许的范围内，你通过服务生成的内容归你所有，你可以用于个人或商业用途。AI 生成的内容可能与他人生成的内容相似，也可能不准确；请在使用前自行核对，特别是文字、商标、人物和产品细节。
你应确保对提交的内容拥有必要的权利，包括他人的肖像、商标、作品等；使用他人肖像须取得本人同意。
公开发布 AI 生成或合成的内容时，请按照适用的法律法规（包括关于人工智能生成合成内容标识的规定）进行标识，不得删除、篡改服务添加的标识。
六、使用规范
你不得利用服务制作、上传或传播：违反法律法规或危害国家安全、社会公共利益的内容；色情、赌博、暴力、恐怖内容；侵犯他人知识产权、肖像权、名誉权或隐私的内容；用于欺诈、冒充他人或误导公众的虚假图像；涉及未成年人的不当内容。
你不得干扰或破坏服务，包括绕过积分计费、以自动化方式大量调用接口、逆向工程服务端、或转售在线 AI 能力。
如你违反本条款，我们可以拒绝相关请求、删除违规内容、暂停或终止你的账户，并依法向有关部门报告。因违规被终止的账户，剩余积分不予退还。
七、知识产权
魄影应用、网站、服务及其中的软件、设计、商标和内置素材（例如滤镜、技能、模板、示例图）归我们或授权方所有。在遵守本条款的前提下，我们授予你个人、非独占、不可转让的使用许可。你用内置素材制作的作品可以正常使用，但不得单独提取、转售这些素材。
应用包含依据开源许可（例如 MIT 许可）使用的软件，相应许可以安装包中附带的声明为准。
八、免责与责任限制
服务按“现状”提供。在法律允许的范围内，我们不对服务不中断、无错误或 AI 结果满足你的特定用途作出保证。
请自行备份重要项目。因你的设备、网络、第三方服务或不可抗力造成的损失，我们不承担责任。
在法律允许的范围内，我们对你的赔偿责任总额，不超过你在引起责任的事件发生前 12 个月内向我们支付的费用。法律规定不得限制的责任除外。
九、服务的变更、中止与终止
你可以随时停止使用服务并删除账户。
我们可能因业务调整、维护或法律要求变更、中止或终止部分或全部服务。终止在线服务前，我们会提前至少 30 天在网站或应用中通知；对于你付费购买但尚未使用的积分，我们会按实际情况给出合理的处理方案。
十、条款的变更
我们可能修改本条款。重大变更会在网站或应用中提示，并在生效前给你合理的时间了解；变更生效后继续使用服务，即表示你接受修改后的条款。
十一、适用法律与争议解决
本条款适用美国特拉华州法律及适用的美国联邦法律，不考虑其冲突法规则。因本条款或服务产生的争议，双方应先友好协商；协商不成的，由位于美国特拉华州的州法院或联邦法院管辖。
如果你所在国家或地区的法律给予消费者不能通过协议排除的权利，本条款不影响这些权利。

Terms of Service
Effective September 30, 2026
Welcome to Ploctor. These terms are the agreement between you and the Ploctor team ("we") for using the Ploctor Mac app, the ploctor.com website and the related online services (the "Service"). By creating an account, buying credits or a subscription, or using the Service, you agree to these terms and the Privacy Policy. If you do not agree, please stop using the Service.
1. Your account
You must be at least 14 to create an account; if you are under 18, use the Service with a parent's or guardian's consent and guidance.
Give a real email address and keep your password safe. What is done through your account is treated as done by you; if someone else uses it, tell us at once.
An account is for one person and may not be sold, rented or transferred.
2. The Service
The app's local editing — layers, masks, selections, color, filters, retouching, type and more — is free and needs no account.
Online AI features — generating and editing images, upscaling, cutouts, splitting layers, the assistant — need you to sign in and use credits each time. The expected credits show before you send; if a job fails, the credits held for it are returned.
Online AI is provided by third-party model providers. Available models, their quality, speed and price may change with the providers; we work to keep the Service stable but cannot promise every model is always available.
We may update, add or change features from time to time. The app updates itself.
3. Credits, subscriptions and payment
Credits pay for online AI. They do not expire (see section 9 if the Service ends), but they cannot be exchanged for cash or moved to another account.
Subscriptions renew monthly or yearly until you cancel; you can cancel any time before renewal and keep using it until the period ends. Yearly plans grant their credits month by month.
Credit packs are one-time purchases. Prices are as shown when you buy and may include taxes or fees charged by the payment channel. Price changes do not affect completed purchases; subscribers see a new price before their next renewal.
Website payments are handled by Stripe; for purchases in the App Store, Apple's rules for payment, renewal and refunds apply.
4. Refunds
Credits and subscriptions are digital services available as soon as they are bought, so they are not refundable as a rule.
We refund, after checking, when you were charged twice; when a fault on our side meant a payment gave you no credits or a subscription could not be used; and where the law requires a refund. Email support@ploctor.com with the order number within 30 days of paying.
When a payment is refunded, the credits it granted are taken back in proportion. If you dispute a charge with your bank or payment provider, the related credits are frozen or taken back while it is settled.
5. Your content and AI results
The pictures you upload, the text you enter and your projects ("your content") belong to you or their owners. You let us handle your content as far as running the Service needs, including sending it to model providers to fulfil your requests. We never use your content to train models.
As far as the law allows, what you create with the Service is yours to use personally or commercially. AI results may resemble what others create and may be inaccurate; check them before use, especially text, trademarks, people and product details.
You must hold the rights needed for what you send, including other people's likenesses, trademarks and works; using someone's likeness needs their consent.
When you publish AI-generated or synthesized content, label it as the applicable laws and regulations require (including rules on labeling AI-generated content), and do not remove or alter labels the Service adds.
6. Acceptable use
Do not use the Service to make, upload or spread: content that breaks the law or harms national security or the public interest; pornography, gambling, violence or terrorism; content that infringes others' intellectual property, likeness, reputation or privacy; fake images meant to defraud, impersonate or mislead; or improper content involving minors.
Do not interfere with the Service, including getting around credit charges, calling it automatically at scale, reverse engineering the server, or reselling its online AI.
If you break these terms we may refuse requests, remove content, suspend or end your account, and report to the authorities as the law requires. Credits left in an account ended for a breach are not refunded.
7. Intellectual property
The Ploctor app, website and Service, with their software, design, trademarks and built-in material (such as filters, skills, templates and sample pictures), belong to us or our licensors. As long as you follow these terms, we give you a personal, non-exclusive, non-transferable license to use them. Work you make with built-in material is yours to use, but the material may not be extracted or resold on its own.
The app includes software used under open-source licenses (such as the MIT license); the notices shipped with the installer apply.
8. Disclaimers and limits of liability
The Service is provided "as is". As far as the law allows, we do not promise it will be uninterrupted or error-free, or that AI results will suit a particular purpose.
Back up important projects. We are not responsible for losses caused by your device, your network, third-party services or events beyond our control.
As far as the law allows, our total liability to you is limited to what you paid us in the 12 months before the event that caused it, except for liability the law does not allow to be limited.
9. Changes to, suspension and end of the Service
You can stop using the Service and delete your account at any time.
We may change, suspend or end part or all of the Service for business reasons, maintenance or legal requirements. Before ending the online services we will give at least 30 days' notice on the website or in the app, and offer a reasonable arrangement for credits you paid for and have not used.
10. Changes to these terms
We may change these terms. We will point out significant changes on the website or in the app and give you reasonable time to review them before they apply; using the Service after that means you accept them.
11. Governing law and disputes
These terms are governed by the laws of the State of Delaware and applicable United States federal law, without regard to conflict-of-law rules. Both sides will first try to settle any dispute by negotiation; failing that, it goes to the state or federal courts located in Delaware.
If the law where you live gives consumers rights that cannot be excluded by agreement, these terms do not affect those rights.
